It’s common for employers to be unaware that when workers dress smartly in black attire, including black footwear, it may pose a serious risk if HMRC initiated an NMW inspection.
In recent years, HMRC has taken an incredibly strong stance with uniform/dress code policies.
Particularly, when workers are required to wear clothing in a specific colour without compensating for the expense, and where such costs bring worker’s pay below minimum wage.
Luckily, we were able to identify the risks in this instance before HMRC got involved and successfully collaborated with the business to reduce the risk and update policies.
And I got to work with one of my favourite restaurants. 🙂
